These terms and conditions outline the rules and regulations for the use of parksby technologies's Website, located at https://parksby.io and all its Mobile Application Softwares.
By accessing this website and/or application we assume you accept these terms and conditions. Do not continue to use parksby if you do not agree to take all of the terms and conditions stated on this page.
All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services, in accordance with and subject to, prevailing law of the country. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to the same.
We may terminate or suspend Your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions. We may also suspend your access to the Application and/or Website (whether or not you have an account with us) if we believe you to be in breach of this Agreement.
To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of this Terms), even if the Company or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.
We will not be liable to you for any loss or damage, in the event of a claim by a user on our application against you and, or your property, or anyone connected to you or your property. Nor shall we, in such circumstances, be required to return any money received by us under this Agreement to either you or the user with whom you transacted.
We shall not be liable to you in any way whatsoever if you suffer any loss as a result of any governmental authority or any other relevant public authority bringing proceedings against you or taking any other action against you as a result of listing the Parking Space on the Website.
To use certain features of the Service, You may be required to register for an account. You agree to provide accurate and complete information and to keep this information up to date. You are responsible for safeguarding your account credentials and for any activities or actions under your account.
Users may upload content such as images, descriptions, or location data. By uploading such content, you warrant that you own or have the necessary rights to share it. You grant Parksby a non-exclusive, royalty-free license to use, reproduce, and display such content for the purpose of operating the Service. Parksby is not responsible for the accuracy or legality of user-uploaded content.
Parksby shows parking from three kinds of source: operators who list their own car parks, public open-data publishers such as cities and transport authorities, and drivers who add or update places they know. Each car park shows where its information comes from.
Availability ("Open", "Busy", "Full", a number of free spaces, or the status of a charger) is our best reading of what the source reported and how recently. It can be out of date or wrong. It is not a reservation, and a space shown as free may be taken by the time you arrive. Prices, opening hours and parking rules are shown as published or reported; always follow the signs and rules at the car park. Parksby is not responsible for fines, clamping, towing or other charges you incur while parking.
Anyone may add a car park to Parksby as information, so drivers can find it, whether or not they own it. Only its owner, or someone the owner has authorised, may take bookings or payments for it through Parksby (see below). By adding a car park you confirm that, to the best of your knowledge, the details are accurate. An operator may claim a car park added by someone else.
Taking bookings or payments for a Parking Space through Parksby is different: to do so you must own the Parking Space or be authorised by its owner, and you are answerable to the relevant authorities for it.
We rely on the details provided by the Seller about a Parking Space listed for booking, and we offer no guarantee as to their accuracy or the space's suitability for your requirements.
For bookable Parking Spaces, the website and application are platforms for spaces owned or controlled by Sellers. We have no responsibility for the Parking Space beyond the services in this Agreement: displaying its location, availability and price, confirming and ending parking sessions, and collecting payment on behalf of the Seller.
You can update a car park in the app: how full it is, a problem (a broken barrier, no attendant, a blocked entrance, a closure), a photo, or a correction to its price or hours. Reports are shown to other drivers for a limited time (currently 45 minutes for how full a car park is, 6 hours for a problem, and until midnight for a closure). Photos are checked by Parksby before they appear.
By contributing you grant Parksby a worldwide, perpetual, royalty-free, non-exclusive licence to use, reproduce, edit, publish and share your contributions, including in combined or aggregated form, for operating and improving the Service and for parking data Parksby provides to others. Do not submit anything you do not have the right to share, anything false or misleading, or photos in which people or vehicle number plates can be identified. Parksby may remove any contribution and may withdraw points earned through contributions that break these Terms.
Parksby is free to use. Premium is an optional paid plan that adds features such as exact numbers of free spaces where a car park or city publishes them, alerts when a car park has space or is filling up, and when a car park is usually busy. Premium shows the same information as the free plan where only driver reports exist, and it does not guarantee that a space will be free.
Premium is sold as a Day or Week pass, which ends by itself, and as a Month plan. Paid by card on our website, through Google Play or through the App Store, the Month plan renews automatically each month until you cancel; paid by M-PESA it covers 30 days and does not renew. You can cancel a renewal at any time: on the website from the Pricing page, on Android from your Google Play subscriptions, and on iPhone from your Apple Account subscriptions. You keep Premium until the end of the period you have paid for. Purchases made through Google Play or the App Store are also governed by that store's terms, including its refund policy. Refunds for purchases made on our website are handled as required by applicable law; contact us at contact@parksby.io.
Leave-by alerts, "tell me when" alerts and other notifications are sent on a best-effort basis. They depend on the data we receive, on your device and on third-party delivery services, and may arrive late or not at all. Do not rely on them as your only way of reaching a car park on time.
Some parking and charging information comes from public open-data publishers under their own licences. It is credited in the app on the car park or charger it describes. Parksby does not claim ownership of that information, and its publishers make no promise about it through Parksby.
For bookings, we charge the Seller a commission at a rate, which is variable but not exceeding 30%, on payments made for parking booked through our Application and Website. Premium is priced separately (see Premium).
In the case of making reservations, you will be charged a non-refundable down payment equal to the hourly charge of the parking space you are trying to reserve.
You agree to pay all charges or fees at the prices then in effect for your parking, and you authorize us to charge your chosen payment provider for any such amounts upon exiting or reserving the parking space.
We reserve the right to correct any errors or mistakes in pricing, even if we have already requested or received payment. We also reserve the right to refuse any parkings or reservations done using the Service.

We employ the use of cookies. By accessing parksby, you agreed to use cookies in agreement with the parksby technologies's Privacy Policy.
Most interactive websites use cookies to let us retrieve the user’s details for each visit. Cookies are used by our website to enable the functionality of certain areas to make it easier for people visiting our website. Some of our affiliate/advertising partners may also use cookies.
Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection, use, and disclosure of information as described in our Privacy Policy.
You agree to comply with all applicable laws, regulations, and third-party rights. Sellers are solely responsible for ensuring they have the legal right to list and lease parking spaces, including obtaining any necessary permits or licenses.
Parksby shall not be held liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to natural disasters, government actions, internet outages, or labor disputes
These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya. You agree to submit to the exclusive jurisdiction of the courts of Kenya for the resolution of any disputes.
Unless otherwise stated, parksby technologies and/or its licensors own the intellectual property rights for all material on parksby. All intellectual property rights are reserved. You may access this from parksby for your own personal use subjected to restrictions set in these terms and conditions.

These Terms and Conditions may have been translated if We have made them available to You on our Service. You agree that the original English text shall prevail in the case of a dispute.

(a) the link would not make us look unfavorably to ourselves or to our accredited businesses;

By choosing to use our Service and/or Website, you do so at your own risk. You acknowledge and agree that Parksby does not have an obligation to conduct background checks on any Seller or Buyer.
We are not responsible for the location or condition of a Parking Space, its availability or the conduct of the Seller. We act only as a platform for both the Seller and the Buyer to reach an agreement on the leasing of the Parking Space.
